Probate is the legal process of administering a deceased person's estate. It involves validating the will, identifying and inventorying assets, paying debts and taxes, and distributing remaining assets to beneficiaries.

The Probate ProcessStep by Step
Understanding what happens during probate administration
Filing the Petition
We file the petition for probate with the court, along with the death certificate and original will (if one exists). The court will issue letters of administration.
Notice to Beneficiaries & Creditors
Legal notice is given to all beneficiaries, heirs, and potential creditors. This includes publishing notice in a local newspaper and sending formal notices by mail.
Asset Inventory & Appraisal
We help clients identify and inventory all assets of the estate, including real estate, bank accounts, investments, personal property, and business interests. Professional appraisals may be required.
Debt Payment & Tax Returns
All valid debts and expenses are paid from estate assets. We work with CPAs to make sure the necessary tax returns are filed, including final income tax returns and estate tax returns if applicable.
Asset Distribution
After all debts are paid and court approval is received, remaining assets are distributed to beneficiaries according to the will or Florida intestacy laws.
Final Accounting & Closing
A final accounting is filed with the court showing all transactions. Once approved, the estate is closed and the personal representative is discharged from their duties.

Summary Administration
Requirements:
Estate under $75,000 or deceased more than 2 years
Simplified probate process for smaller estates with reduced court supervision and faster resolution.

Requirements:

Requirements:
Out-of-state decedent with Florida property
Special probate for non-Florida residents who owned property in Florida at death.
