Formal Probate Timelines

In Florida there are a lot of factors that goes into how long it takes to probate an estate, but it is probably one of my most frequently asked questions I get.

First Steps

  • Takes 1-2 weeks to obtain a death certificate
  • Paperwork can be completed a few days after receiving the death certificate
  • Takes a few weeks for the judge to review and enter Letters of Administration

Next Steps

  • Publish "Notice to Creditors" in newspaper for two consecutive weeks
  • Creditors have 90 days to file claims
  • Tax completion depends on time of year and deceased's tax filing status
  • If taxes are current, probate may conclude shortly after creditor period
  • If taxes need filing, may need to wait until following year for documents

Final Steps

  • Distribute estate and close probate after taxes are resolved
